Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the Lendli app and website (the “Service”) operated by Lendli (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

Lendli SMS Terms and Conditions

Program Name: Lendli Notifications

Program Description: Opt-in to receive SMS notifications from Lendli to stay informed about your account and item lending activities. Please note, Lendli facilitates the lending and borrowing of physical items only, not financial lending. This service is designed to provide important updates and reminders directly related to your transactions and account management.

How to Opt-In: To receive SMS notifications, you must actively select the opt-in checkbox during the registration process or update your preferences in your account settings. By opting in, you expressly consent to receive text messages regarding your lending activities and account status. Opting in is entirely voluntary and is not a prerequisite for using any services provided by Lendli.

Opt-Out Information: You can opt out of receiving SMS notifications at any time. Simply text “STOP” to the number provided in our messages. After you send the SMS message “STOP,” you will receive a confirmation message, and no further messages will be sent to you unless you opt back in.

Message Frequency: Message frequency may vary (no fixed schedule).

Fees and Data Rates: Message and data rates may apply for any messages sent to you from us and to us from you. If you have questions about your text or data plan, please contact your wireless provider.

Customer Support: For help or more information about our SMS service, text “HELP” to the number provided, or contact our support team via email at support@lendli.co.

Privacy Policy: Your privacy is important to us. Please review our Privacy Policy, which explains how we handle and protect your personal information.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

Changes to Terms: Lendli reserves the right to modify or terminate the SMS notifications service or change these terms at any time. Notice of modifications will be communicated to you via email or through our website.

Service Availability: The SMS service is available through various carriers but may not be accessible in all areas. Not all mobile devices or handsets may be supported.

Governing Law: These terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions.

Using the Service

You must follow any policies made available to you within the Service. You may use the Service only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Service to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Your Lendli Account

You may need a Lendli account in order to use some of our Service. You may create your own Lendli account, or your Lendli account may be assigned to you by an administrator, such as your employer or educational institution. If you are using a Lendli account assigned to you by an administrator, different or additional terms may apply, and your administrator may be able to access or disable your account.

To protect your Lendli account, keep your password confidential. You are responsible for the activity that happens on or through your Lendli account. Try not to reuse your Lendli account password on third-party applications. If you learn of any unauthorized use of your password or Lendli account, contact our support team immediately.

Privacy and Copyright Protection

Lendli’s privacy policies explain how we treat your personal data and protect your privacy when you use our Service. By using our Service, you agree that Lendli can use such data in accordance with our privacy policies.

Your Content in Our Service

Some of our Service allows you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.

When you upload, submit, store, send or receive content to or through our Service, you give Lendli (and those we work with) a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with our Service), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our Service, and to develop new ones. This license continues even if you stop using our Service.

Modifying and Terminating Our Service

We are constantly changing and improving our Service. We may add or remove functionalities or features, and we may suspend or stop a Service altogether. You can stop using our Service at any time, although we’ll be sorry to see you go. Lendli may also stop providing Service to you, or add or create new limits to our Service at any time.

Our Warranties and Disclaimers

We provide our Service using a commercially reasonable level of skill and care, and we hope that you will enjoy using them. But there are certain things that we don’t promise about our Service.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER LENDLI NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICE. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICE, THE SPECIFIC FUNCTIONS OF THE SERVICE, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICE “AS IS”.

Liability for our Service

WHEN PERMITTED BY LAW, LENDLI, AND LENDLI’S SUPPLIERS AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF LENDLI, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICE (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICE AGAIN).

IN ALL CASES, LENDLI, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

Business Uses of Our Service

If you are using our Service on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Lendli and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Service or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorneys’ fees.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
